BLUE HERON BLVD., PALM BEACH COUNTY PCN 56-43-42-30-25-001-0000, (TRACT ‘1’ OF BLUE HERON WALGREENS, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 84, PAGE 179, OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA) FROM FSADECV FL C4 LLC IN THE AMOUNT OF TWO MILLION FOUR HUNDRED THOUSAND DOLLARS ($2,400,000) PLUS CLOSING COSTS FOR THE PURPOSE OF CONSTRUCTING A NEW FIRE STATION TO REPLACE THE CITY’S FIRE RESCUE STATION 88; AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE THE AGREEMENT FOR PURCHASE OF REAL PROPERTY FOR SAID PROPERTY; AUTHORIZING THE DIRECTOR OF FINANCE TO MAKE PAYMENT OF  TWO MILLION FOUR HUNDRED THOUSAND DOLLARS ($2,400,000) PLUS CLOSING COSTS FROM PROJECT NUMBER 18034 UNDER THE TERMS OF THE SALE AND PURCHASE AGREEMENT; AND PROVIDING FOR AN EFFECTIVE DATE.

Recommendation/Motion: The Office of the City Attorney recommends approval of the Sale and Purchase Agreement.

Background/Summary: 

The City of Riviera Beach Fire Rescue Station 88, located at 1663 W. Blue Heron Blvd., has been demolished and the City of Riviera Beach Fire Rescue Department is in need of a new fire station facility located along the W. Blue Heron Boulevard corridor to replace Fire Rescue Station 88. 

 

City staff has identified an ideal property and concluded negotiations with the respective owner, FSADECV FL C4, LLC., to enter into an Agreement for Sale and Purchase of Real Property (hereinafter “Purchase Agreement”) for Two Million, Four Hundred Thousand Dollars ($2,400,000) plus closing costs for the acquisition of the subject parcel located at 1920 W. Blue Heron Blvd., Riviera Beach, FL, more particularly described as  Palm Beach County Parcel Control Number: 56 - 43- 42 - 30 - 25- 001 – 0000, Tract ‘1’of BLUE HERON WALGREENS, according to the Plat thereof, as recorded in Plat Book 84, Page 179, of the Public Records of Palm Beach County, Florida. City staff believes that the Sale and Purchase Agreement will satisfy the City’s desire to construct a new fire station on a similarly situated but larger parcel along W. Blue Heron Blvd., thereby maintaining Fire Rescue’s timely response to emergency calls throughout the area. The City will have an inspection period commencing on the date of the Sale and Purchase Agreement through 5:00P.M. on the fifteenth (15th) day following the Effective Date to inspect and evaluate the physical and other conditions of or with respect to the property, including an inspection of the structural conditions and an environmental assessment thereof. The Closing Date is scheduled on or before August 19, 2020. The parcel is located in the General Commercial District and has a zoning designation of CG General Commercial, intended to promote uses developed for retail and service needs of the entire community.  The Future Land Use Map has the property designated as commercial.  The Zoning Map designates the property as general commercial.  The use anticipated for this parcel is a community facility use. Therefore, in order for the City to be in compliance with its own Comprehensive Plan, the City would need to amend the Future Land Use Map and Zoning Map from Commercial General (CG) use to Community Facility (CF) Future Land Use and Community Facility Use.  Prior to issuing any development orders to move forward with construction, the Comprehensive Plan amendment and Zoning Map amendment would need to go to the City’s Planning & Zoning Board, and to the City Council for first and second readings. The Office of the City Attorney has submitted the location and information on the acquisition of this real property to the Planning and Zoning Board for its information as required by Section 27-36 of the City Code of Ordinances. City staff also believes that the Sale and Purchase Agreement will provide a great benefit to the entire citizenry of Riviera Beach and allow the Fire Rescue Department facilities to be greatly improved and upgraded.
