On August 19, 2014, the City of Riviera Beach entered into an Inter-local Cooperation Agreement with the Palm Beach County Board of County Commissioners as a part of its Urban County Program (Agreement). More specifically, under this respective Agreement, the City has authorized the receipt of the federal Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) monies via a sub-recipient relationship with Palm Beach County.
The initial Agreement states that “The Agreement shall be automatically renewed at the end of the qualification period and at the end of each subsequent qualification period unless either party provides a written notice in which it elects to not participate in a new qualification period.” To this end, the current three-year qualifying period expires on September 30, 2021, and will renew to cover the period of October 1, 2021, to September 30, 2024.
At this time, Palm Beach County (County) is requesting that the City formally inform it of the City’s intent to continue participation in the Urban County Program for the Fiscal Year 2021-2023 time period. Further, the County is also notifying the City that HUD has amended Clause 11 of the referenced Agreement to include Section 3 language which ensures that employment and other economic opportunities generated by HUD financial assistance shall, to the greatest extent feasible, be directed to low- and very-low-income persons, particularly those who are recipients of government assistance for housing and to business concerns which provide economic opportunities to low- and very-low-income persons.
Thereby, the County has provided the City with a document referencing the new language pertaining to Section 3, for the City to review and execute which shall become Amendment 001 to the Inter-local Cooperation Agreement.
