| | | | | | | | Background/Summary: | On or about February 6, 2019, the Plaintiff filed a Petition for Writ of Mandamus against the City of Riviera Beach, Florida, in the Circuit Court in and for the 15th Judicial Circuit, Case No. 502019CA004472XXXXMBAY. The Plaintiff allleged that the City unlawfully refused to transmit Plaintiff's appeal to the City's Development Special Magistrate regarding the application of off-site parking laws to a pending application for approval to redevelop what is generally known as the "Crab Pot" site. The parties, after mutual negotiation, have reached a settlement to resolve this matter. As a condition of settlement, the City agrees to schedule a City Council workshop on the Crab Pot redevelopment at a time mutually agreed upon by both parties and before any action is taken with respect to the Crab Pot. As another condition of settlement, the Plaintiff agrees to file a Notice of Dismissal of the Petition. The City finds that authorizing this Settlement Agreement is in the best interests of the City and serves a valid public purpose. |
