City staff desires to inform the City Council and general public of the current status of the ongoing Comprehensive Plan Amendment process prior to presenting second reading of the associated Ordinance. On August 1, 2018, the City Council approved the first reading of an Ordinance which initiated amendments to the Comprehensive Plan. These amendments consisted of deletion of any reference to former Florida Administrative Code Rule 9J-5, as well as identifying existing language within the Comprehensive Plan that may satisfy Peril of Flood requirements. This information was provided to the Florida Department of Economic Opportunity (DEO) by City staff which initiated the State Coordinated Review Process pursuant to Section 163.3184 Florida Statutes, entitled, "Process for adoption of comprehensive plan or plan amendment".
DEO provided confirmation that the City may proceed with second reading and adoption of the Comprehensive Plan Amendment Ordinance on May 17, 2019. As provided by DEO, the City may now choose to adopt, adopt with changes, or not adopt the proposed amendment. City staff desires to provide the second reading of this ordinance for consideration at the next available City Council Meeting (November 6, 2019) and will request that the City Council adopt the Ordinance with changes in order to approve the deletion to reference to former Rule 9J-5, which results in the deletion of three sentences (see Exhibit A). Also, this Ordinance will preclude any amendments associated with Peril of Flood requirements in order to provide additional time for City staff to fully satisfy these requirements with a future amendment.
Overall, there are multiple items within the City's Comprehensive Plan which require additional review and potential amendments. City staff believes that seeking assistance from the Treasure Coast Regional Planning Council (TCRPC) to assist with this often technical and time consuming process would prove to be beneficial. We anticipate proposing an agenda item providing TCRPC assistance for City Council consideration in the near future.
