On October 19, 2005, the City of Riviera Beach Utility Special District (District) and the Town of Mangonia Park, Florida (“Town”), entered into an intergovernmental agreement (Agreement) for the District to provide wastewater transmission, treatment, and disposal utility service for the Town’s wastewater utility system. The Agreement was for a term of fifteen (15) years, set to expire on October 19, 2020. The provision on the term of the Agreement provides that the Agreement shall automatically renew for an additional term of fifteen (15) years, unless either party provides notice to the other if its intention not to renew the Agreement within twelve (12) months prior to the expiration of the original term.
The District believes it is in the best interests of the District to provide notice to the Town of its intention not to renew the Agreement. On October 1, 2019, the City Manager provided written notice to the Town of the District’s intent not to renew the Agreement. Approval by the District Board of this Resolution would ratify said notice provided to the Town of the District’s intention not to renew the Agreement and authorize the City Manager to provide correspondences on behalf of the District regarding the Agreement.
