This Interlocal Agreement was brought before and approved by the Board on two occasions, February 25, 2019 and September 11, 2019. The impetus centered on the fact that Palm Beach County adopted a new ordinance and that ordinance necessitated the changes.
Basically, the County has adopted certain policies and procedures regarding open cuts across its thoroughfare and non-thoroughfare roads. Accordingly, the City has agreed to follow the policies and procedures set forth by the County regarding such open cuts on County roads.
In cooperation, the City is not being required to obtain a surety bond for any open cuts, but, instead will be bound by the terms and conditions of the respective Interlocal Agreement. Further, the City agrees to be responsible for repairing the open cuts, in accordance with the County's policies and procedures, and all costs associated with such repairs.
