Jonathan Evans was formerly employed as the City Manager of the City of Riviera Beach. Mr. Evans filed a charge of discrimination against the City with the Equal Employment Opportunity Commission, Charge No. 510-2018-04191. Mr. Evans also filed a complaint in the United States District Court for the Southern District of Florida against the City, Councilperson Terence D. Davis, Councilperson Lynne L. Hubbard, and Councilperson Dawn Pardo, et al, Case No. 9:18-CV-80687. The City and Jonathan Evans entered into a Settlement Agreement and General Release (“Agreement”) on July 30, 2018, executed by the City on August 3, 2018, which included a provision that neither party would apply for nor accept employment with the City at any time in the future, a provision found in paragraph H of the Agreement. On April 10, 2019, the City Council unanimously agreed to approve an Amendment to the Settlement Agreement and General Release (“Amendment”) by deleting and removing Paragraph H in its entirety (attached hereto). On April 11, 2019, Jonathan Evans signed the Amendment.
The purpose of this resolution is to memorialize the action that took place on Wednesday, where the city council unanimously voted to amend the settlement agreement and general release in the case Jonathan Evans V. the City of Riviera Beach.
