Tradrick McCoy brought suit in Palm Beach County Circuit Court against the City of Riviera Beach; Lynne Hubbard, in her official capacity as City Councilperson for the City of Riviera Beach, and Claudene Anthony, as City Clerk and Custodian of Records on December 6, 2018, Case No. 2018-CA-015244. Mr. McCoy alleged in his complaint that the City violated Article I, Section 24 of the Florida Constitution and the Public Records Act and Chapter 119, Florida Statutes by failing to respond to his public records request in a timely fashion.
On January 14, 2019, the parties attended mediation in which Counsel for the City negotiated and proposed a settlement agreement to settle the case for all documented costs, not to exceed $1000, and the total costs of mediation, subject to City Council approval.
On February 6, 2019, the members of City Council, along with the City Manager, the City Attorney, and outside counsel for the City met in a closed door session to discuss settlement negotiations.
