Scripps Media, Inc. brought suit against the City Riviera Beach and Terence Davis, in his official capacity as City Councilman for the City of Riviera Beach.  Scripps Media Inc., as Plaintiff, alleged that the City violated Article I, Section 24 of the Florida Constitution and the Public Records Act and Chapter 119, Florida Statutes, by failing to respond to WPTV’s request in a timely fashion, by failing to adequately maintain records, and by failing to produce public records.  On December 12, 2018, members of the City Council attended a closed door executive session with Counsel for the City to discuss a potential settlement and attorney’s fees in the case.  Counsel for the City and Counsel for Scripps Media, Inc., subsequently negotiated a settlement for $50,000 inclusive of costs and attorney’s fees, subject to City Council approval.  The City Attorney recommends approving the Stipulated Final Judgment and authorizing Gallagher Bassett to make payment in the amount of $50,000 in the best interests of the City.
