The applicant, Seven Kings Holdings, LLC, has applied for site plan approval (SP-16-18) associated with the vacant property know by parcel control number 56-43-42-28-00-003-0090; 386 E. Blue Heron Blvd. The applicant desires to construct a 4,482 square foot restaurant on said parcel of land, which is approximately 0.35 acre in size.
The Planning and Zoning Board reviewed the site plan application during a public meeting on May 11, 2017 and also on June 8, 2017, whereby the Board recommended disapproval of the project to the City Council with a 5 to 2 vote. The Community Redevelopment Agency Board of Commissioners reviewed the site plan application during a public meeting on October 25, 2017 and on August 8, 2018. Meeting minutes from the abovementioned meetings have been attached to this agenda item for reference.
City staff finds that the proposed site plan application is consistent with the City’s Comprehensive Plan as well as the City’s Code of Ordinances and Land Development Regulations. As provided by City Code, the Site Plan proposes to utilize on-street parking located directly in front of the property line in order to fulfill the parking requirement of 15 spaces (restaurants require 1 parking space for every 300 square feet of building area; see City Code Sec. 31-539). Since the adjacent street right-of-way is controlled by FDOT, the applicant must submit an executed agreement with FDOT to the City, prior to issuance of a City Building Permit for this project proposal.
The Palm Beach County Traffic Division determined that the development proposal is located within the City's Traffic Concurrency Exemption Area and meets the County's Traffic Performance Standards. Please reference attached correspondence dated September 26, 2016.
Additionally, Seven Kings Holdings, LLC, entered into a private agreement with the Marina Grande Master Association, in order to establish guidelines associated with hours of operation, amplified music, site security, trash pickup and other operational items. Said agreement established hours of operation to be from 11:00AM to 10:00PM Sunday through Thursday, and 11:00AM to 11:00PM Friday and Saturday. According to the Agreement, amplified live music may only occur on Saturdays, Sundays, and nationally recognized holidays, and must cease at 7:00PM.
City staff advises that the City Council review and consider all information presented. If the City Council desires to approve this project proposal, City staff recommends specific conditions of approval, as identified within Section 2 of the associated Resolution.
