Subject: Resolution to ratify the Labor Agreement between the City of Riviera Beach and Professional Managers and Supervisors Association.

Recommendation/Motion: That City Council approve the resolution authorizing the City Manager and City Clerk to sign the Labor Agreement between the City and the Professional Managers and Supervisors Association.  This union represents the supervisors of the City.

Background/Summary: 

The Professional Managers and Supervisors Association (PMSA) has a collective bargaining agreement with the City that has expired. The City has been in negotiations with PMSA for a new collective bargaining agreement that will take effect August 15, 2018, should the Council approve the contract, and remain in effect through August 14, 2021.  The City and PMSA conducted eight negotiations session that commenced September 14, 2016 through October 30, 2017.  The PMSA membership rejected the agreement on February 16, 2018.  The City and PMSA returned to negotiations for three (3) additional session starting on June 14, 2018 and concluded on July 27, 2018.  PMSA unanimously voted to ratify the contract on August 8, 2018

 

The parties have tentatively agreed on the following provisions:

Article 15, Section 6:  PMSA members have a right to voluntarily demote himself or herself after a promotion within the first 90 days of the promotion, so long as the previous position has not be filled on a full-time basis.

 

Article 20, Section 3.C. – For those employees that are required to work stand-by duty, they are guaranteed two hours of straight time pay for every eight hours of stand-by time assigned, along with all actual time worked.

 

Article 21, Section 1 – The holiday list was updated to reflect President’s Day as a holiday instead of Washington’s Birthday.

 

Article 21, Section 2 – Probationary employees were included in employees able to receive paid time off for holidays.

 

Article 23, Section 11 – Methadone and alcohol were added to the list of substances/drugs for which the City may test employees.

 

Article 26, Section 2 – Coursework for the education reimbursement program is required to be from an accredited college or university.

 

Article 26, Section 5 – Any PMSA employee completing an Associated Degree (AA/AS) as a result of the tuition reimbursement program can receive a $250.00 one-time bonus upon receiving said degree. Any PMSA employee completing a Bachelor’s Degree (BA/BS) as a result of the tuition reimbursement program can receive a $500.00 one-time bonus upon receiving said degree.  Any PMSA employee completing a Master’s Degree (MBA/MS/MA) as a result of the tuition reimbursement program can receive a $750.00 one-time bonus upon receiving said degree.  Any PMSA employee completing a Doctoral or Professional Degree (PhD/JD) as a result of the tuition reimbursement program can receive a $1,000.00 one-time bonus upon receiving said degree.

 

Article 27, Section 1 – All bargaining unit employees will receive a 12% increase in base pay once the agreement become effective.  There is no retroactive pay.  Moreover, each bargaining unit member shall receive a one-time signing incentive for the agreement in the amount of $1,000.00, as long as certain criteria is met.  Beginning August 15, 2019, each bargaining unit member will receive a 2% increase in base pay.  Beginning August 15, 2020, each bargaining unit employee will receive a 2% increase in base pay.

 

Article 27, Section 3 – The Union will have the ability to request a re-opener after January 1, 2020 regarding certification payments.

 

At this time the City Administration requests that City Council approve the Resolution to ratify the attached PMSA contract.
