In 1992 Palm Beach County (PBC) received title to Lot 124 of the Molphus Heights plat 1, recorded in plat book 9, page 58 of the public records of Palm Beach County, Florida, through a Tax Deed. In 2003 PBC transferred the property to the City of Riviera Beach via a County Deed. In 2003 Palm Beach County Roadway Division began design for the reconstruction of Silver Beach Road from Congress Avenue to President Barack Obama Highway. During the design, it was determined that an access road would be required to prevent residents along the south side of Silver Beach from backing out of their driveways directly onto the County thoroughfare. The access road shall be known and addressed as West 37^th Court upon completion of construction. After construction of the Project, the City of Riviera Beach agrees to take ownership of West 37^th Court and appropriate such funds as may be necessary for the continued operation and maintenance of the local street.

Staff requests that City Council approve the resolution for the donation of Lot 124 of the Molphus Heights plat 1, recorded in plat book 9, page 58 of the public records of Palm Beach County, Florida, to PBC and; acceptance of ownership of West 37^th Court and allocation of future funding for the operation and maintenance of the new local street.
