The Homeowners Association of Turtle Cay has expressed a desire to enter into a Traffic Control Jurisdiction Agreement with the City of Riviera Beach for enforcement of Traffic Laws within its boundaries.
Turtle Cay owns or controls the roadways within its development as private roads.
Florida State Statutes Section 316.006(2)(b)(4) provides that the City may exercise Traffic Control Jurisdiction upon the majority vote of the Homeowners' Association Board of Directors, by written Agreement by a Homeowners' Association, and approval of the municipality's governing body, to have State Traffic Laws enforced by local Law Enforcement Agencies on privates roads that are controlled by the Association.
Turtle Cay has retained Civil Solutions, Inc. to provide professional Engineering Services associated with obtaining an Agreement for Traffic Control with the City of Riviera Beach. Civil Solutions has created an inventory/drawing of existing Traffic Control Devices for roadways throughout the Community of Turtle Cay identified any Traffic Control Devices that did not comply with Florida Department of Transportation Standards and the necessary improvement to bring those Traffic Control Devices into compliance. Construction of the proposed improvements started in March 2017. Upon satisfactory completion of the work, Civil Solutions updated the drawing of Traffic Control Devices to include record drawing information, which was added on January 5, 2018, in order to provide certification that the Traffic Control Devices comply with Florida Department of Transportation Standards as set forth in the Manual on Uniform Traffic Control Devices.
Turtle Cay has provided two (2) signed and sealed copies of a Record Drawing of the Community Roadways and Traffic Control Devices noting that all roadway signage complies with Florida Department of Transportation Standards as set forth in the Manual on Uniform Traffic Control Devices.
Turtle Cay has also provided two (2) signed and Notarized Affidavits executed by the President of the Board of Directors for Turtle Cay Master Association, Inc. stating that all roadways are owned by, maintained by, and under the control of Turtle Cay.
