| | | | | | | | Background/Summary: | On February 12, 2016, Newkirk Engineering, Inc., the authorized agent, submitted the Airgas USA, LLC. official Site Plan application (SP-16-02) to the City. City Staff reviewed the Site Plan application and provided corresponding comments to the applicant. All comments were addressed by the applicant and City Staff has no objections to the Airgas Site Plan application. The Community Development Department reviewed the Site Plan application for compatibility and consistency with the City’s Comprehensive Plan and Land Development Regulations and found that the proposed plan was in compliance.
The applicant is proposing to build a single story 15,107 square foot Industrial Gas Fill and Distribution Facility on 2.92 acres (127,117 square foot) of land. Airgas USA, LLC. has an existing facility onsite with plans to rebuild a new onsite facility upon completion of the proposed development. Airgas USA, LLC. has been operating in the City for 20 years.
The proposed site has an estimated tax value of $375,000 before construction and $2,300,000 after construction. The applicant anticipates 11 employees associated with the proposed development and the hours of operation will be Monday through Friday from 7:30 a.m. to 4:00 p.m.
On June 23, 2016, the Planning and Zoning Board reviewed the Airgas USA, LLC. site plan development proposal and unanimously recommended approval of this project to the City Council.
Staff recommends approval of the proposed site plan application with the following conditions:
- A two-year landscaping performance bond for 110% of the value of landscaping and irrigation shall be required before the certificate of occupancy is issued.
- Construction must be initiated within 18 months of the effective date of the adopting Resolution in accordance with Section 31-60(b), of the City Code of Ordinances. Demolition, site preparation or land clearing shall not be considered construction. Building permit application and associated plans and documents shall be submitted in its entirety and shall not be accepted by City staff in a partial or incomplete manner.
- All future advertising must state that the development is located in the City of Riviera Beach. Fees and penalties in accordance with City Code Sec. 31-554 will be levied against the property owner and/or business for violation of this condition.
- This development must receive final Certificate of Occupancy from the City for all buildings and units approved within five years of the approval of the adopting resolution or the adopting resolution shall be considered null and void, requiring the applicant to resubmit application for site plan approval and re-initiate the site plan approval process.
- Once approved, the adopting resolution shall supersede any previous site plan approval resolutions associated with this property, causing previous site plan approval resolutions to be null and void.
- Once approved, the City council authorizes City staff to approve future amendments to this site plan administratively so long as the site plan does not deviate greater than 5% from the originally approved submittal.
- The applicant agrees to execute a Unity of Title between parcels known by PCN 56-42-42-36-39-000-0020 and 56-42-42-36-39-000-0010 prior to the issuance of a City Building Permit.
- The applicant agrees to provide a 25 foot by 25 foot corner clip right-of-way dedication for future use, adjacent to the intersection of North Military Trail and Dyer Boulevard, prior to the issuance of a Certificate of Occupancy.
