Background/Summary: 

On June 25, 2015, Jon E. Schmidt and Associates, the authorized agent for the Ferber Company for WaWa, Inc., submitted the official Site Plan application (SP-15-11) and Special Exception application (SE-15-02) to the City. The applicant is proposing to build a single story 6,119 square foot WaWa convenience store with 8 fuel pumps and 16 pumping stations. Convenience stores with gas stations are permitted by Special Exception in the General Commercial (CG) Zoning district. City Departmental Staff reviewed the Site Plan and Special Exception application and provided corresponding comments to the applicant.  All comments were addressed by the applicant and City Staff had no objections to the SP-15-11 Site Plan and SE-15-01 Special Exception applications. 

 

The proposed project will have 30-40 employees. The proposed project will operate 7 days a week 24 hours a day. The current tax value of the property is about $2.1 million and the tax value after construction will be about $6.7 million.  

Public Storage, a storage company, is located to the north of the property. The Riviera Beach Preparatory and Achievement Academy, an educational use, is located to the south of the parcel with Limited Industrial (IL) Zoning and Industrial (IND) Future Land Use classification. Utility uses, the South Florida Water Management District drainage/retention parcel, is located to the east of the property with Utilities District (U) Zoning and Utilities (U) Future Land Use classifications. Enterprise Car Rental and Travelodge Hotel are located to the west of the property with General Commercial (CG) and Commercial (COM) Future Land Use classifications.   

 

The existing structure at 7289 Garden Road 101 was built in 1986 and has functioned as a two-story commercial office building for many years and currently has the Palm Beach County Department of Health as a tenant, which lease expires in January 2016. WaWa will replace the two-story commercial office building with a single story convenience store. 

 

On November 12, 2015, the City's Planning and Zoning Board approved the site plan (SP-15-11) and special exception (SE-15-01) applications.    

The Community Development Department found the Site Plan and Special Exception applications compatible and consist with the City’s Comprehensive Plan and Land Development Regulations.  

Staff recommends approval of the site plan and special exception applications subject to the following conditions: 
  • A two-year landscaping performance bond for 110% of the value of landscaping and irrigation shall be required before the certificate of occupancy is issued.
  • Construction must be initiated within 18 months of the effective date of this Resolution in accordance with Section 31-60(b), of the City Code of Ordinances. Demolition, site preparation and/or land clearing shall not be considered construction.  Building permit application and associated plans and documents shall be submitted in its entirety and shall not be accepted by City staff in a partial or incomplete manner.
  • All future advertising must state that the development is located in the City of Riviera Beach. Fees and penalties in accordance with City Code Sec. 31-554 will be levied against the property owner and/or business for violation of this condition.
  • This development must receive final Certificate of Occupancy from the City for all buildings and units approved within five years of the approval of this resolution (by December 2, 2020) or the resolution shall be considered null and void, requiring the applicant to resubmit application and fees for site plan approval and re-initiate the site plan approval process.
  • Once approved, this resolution shall supersede any previous site plan approval resolutions associated with this property, causing previous site plan approval resolutions to be null and void.
  • City council authorizes City staff to approve future amendments to this site plan administratively so long as the site plan does not deviate greater than 5% from the originally approved site plan.
