FOR SITE PLAN APPROVAL TO DEVELOP  3.03 ACRES OF VACANT LAND ON PCN: 56-42-42-25-00-000-7120, WHICH IS LOCATED SOUTH OF SR 710 AND NORTH OF 49TH TERRACE NORTH, FOR A SINGLE  STORY 1,440 SQUARE FOOT MODULAR OFFICE STRUCTURE WITH ONSITE STORAGE AND SALES OF MODULAR UNITS; AND PROVIDING FOR AN EFFECTIVE DATE.

Background/Summary: 

On June 23, 2015, Messler & Associates Consultants Engineers, the authorized agent for 49th Terrace North, LLC., submitted the official Site Plan application (SP-15-10) to the City. The applicant is proposing to build a single story 1,440 square foot modular office structure with onsite storage and sales of modular office units. City Departmental Staff reviewed the Site Plan application and provided corresponding comments to the applicant.  All comments were addressed by the applicant and City Staff had no objections to the SP-15-10 Site Plan application. 

The proposed project will have 3 full-time and 6 part-time employees. The proposed project will operate Monday through Saturday from 8 a.m. to 5 p.m. The current tax value of the property is about $650,000 and the tax value after construction will be about $800,000-$1,000,000. The applicant currently has a facility in West Palm Beach on 45th Street and plans to relocate their operations in its entirety to Riviera Beach. The onsite modular units are used by construction companies, real estate companies, and various companies in need of modular units. 

Amerigas, a propane company, and Harmsco Filtration Products, a liquid filtration company, both are located to the south of the property and both are industrial uses with a general Industrial (IG) Future Land Use classification. There are railroad tracks to the north of the parcel.  

On September 10, 2015, the City's Planning and Zoning Board approved the site plan application (SP-15-10).    

The Community Development Department reviewed the Site Plan application for compatibility and consistency with the City’s Comprehensive Plan and Land Development Regulations. 

Staff recommends approval of the site plan application subject to the following conditions:
  • A two-year landscaping performance bond for 110% of the value of landscaping and irrigation shall be required before the certificate of occupancy is issued.
  • Construction must be initiated within 18 months of the effective date of this Resolution in accordance with Section 31-60(b), of the City Code of Ordinances. Demolition, site preparation and/or land clearing shall not be considered construction.  Building permit application and associated plans and documents shall be submitted in its entirety and shall not be accepted by City staff in a partial or incomplete manner.
  • All future advertising must state that the development is located in the City of Riviera Beach. Fees and penalties in accordance with City Code Sec. 31-554 will be levied against the property owner and/or business for violation of this condition.
  • This development must receive final Certificate of Occupancy from the City for all buildings and units approved within five years of the approval of this resolution (by November 18, 2020) or the resolution shall be considered null and void, requiring the applicant to resubmit application and fees for site plan approval and re-initiate the site plan approval process.
  • Once approved, this resolution shall supersede any previous site plan approval resolutions associated with this property, causing previous site plan approval resolutions to be null and void.
  • City council authorizes City staff to approve future amendments to this site plan administratively so long as the site plan does not deviate greater than 5% from the originally approved site plan.
